Open source is generally regarded under EU law Trying or attempting to circimvent sidestep International laws trade treatys and or conventions would bring a World trade organization fine against those who attempt regulate Open source within the United States

Consider this Microsoft used IBM infrastructure in it's initial development of Window products by modifying IBM PC-DOS would create a double standard and subject to International lawsuits against Public agency's who violate WTO law
