I've heard the software is in the BIOS, so it may be harder to get to. Those that are interested will probably investigate it a little further rather than criticize things they don't know about.
ignorance
It's usually in a non-flashable part of the BIOS, and can also be in the interpartition space on the drive. In either case, formatting the hard drive does nothing to remove it.
