Wayback Machine being sued

In the process of defending Healthcare Advocate (a healthcare advocacy firm, natch) in a trademark dispute with the similarly named Health Care Advocates the Philladelphia law firm of Harding Earley Follmer & Frailey used the Wayback Machine (operated by the Internet Archive) to win the case by showing their client's Web page from several years ago.

The plaintiff, Health Care Advocates, didn't take losing at all well and is now suing Harding Early for alledgedly hacking the Wayback Machine to access the data that they had asked to be blocked which would amount to violations of the DMCA and the Computer Fraud and Abuse Act. The plaintiff is also suing the Internet Archive for breach of contract and fiduciary duty, negligence and other charges.
