Australian Court overturns Samsung Galaxy Tab 10.1 injunction

After a prolonged back and forth legal tussle that saw Samsung’s Galaxy Tab 10.1 repeatedly banned and unbanned in Australia, an Australian Court last week lifted the injunction that had previously shrouded Samsung’s tablet in the land down under.

Samsung is undoubtedly pleased as it won’t be missing out on the busy holiday shopping season.

Samsung’s Galaxy tablet 10.1, which is considered one of the main alternatives to Apple’s iPad has been kept out of the Australian market since late July.

The Australian market, while not huge is the first launch market for Apple products outside the United States.

In late November, Samsung won a rare legal victory after an Australian Federal Court unanimously decided to lift a preliminary injunction, imposed by a lower court, on sales of Samsung’s Galaxy Tab 10.1.

Apple had appealed the decision in the High Court, which is the final court of appeal. Apple could not be reached for comment immediately.

Overall, it’s been a rough few weeks for Apple legal. In addition to the ruling coming out of Australia, they were also on the losing end of court decisions in the US and Germany last week. In the former, Apple’s motion for a preliminary injunction was denied. In the latter, Apple’s line of 3G- enabled iOS products were found to be infringing upon two Motorola patents.
