Apple, Samsung solidify top spots in smartphone market
The thrust of Samsung’s suit, or what it aims to achieve, is a review of the patents which have proven key to Apple’s efforts to secure injunctions against a slew of Samsung smartphones and tablets.
In the latest move, however, Samsung filed a statement of claim in the Federal Court on May 22 seeking a judicial review of four patents it claimed were inappropriately granted to Apple between 2009 and 2010.
The document, sighted by iTnews, claimed the patents were granted “ultra vires,” or beyond the powers of the patent commissioner.
Samsung hoped the review would effectively nullify the patents, which sit at the core of Apple’s case against Samsung’s iPad rival tablet, the Galaxy Tab 10.1
Meanwhile, Apple’s legal case against Samsung here in the U.S. marches on. Most recently, Apple’s efforts to secure a preliminary injunction against the impending release of the Samsung Galaxy S III was denied. In any event, Apple and Samsung’s legal dispute will be headed to trial in July.

And lastly, it’s almost comical that Samsung takes issue with Apple’s standard essential patents given that Samsung has been wielding them in an improper and offensive manner against Apple. And the soap opera continues…
