One enterprising Florida woman got spyware to work for her – by installing it on her cheating husband’s computer.
Beverly Ann O’Brien was using the software to prove her husband was cheating on her. She got her evidence, but at a price. O’Brien was found guilty of violating the Sunshine State’s wiretapping laws.
O’Brien’s lawyers argued that “the monitoring didn’t fall under the law’s prohibitions and was akin to reading a stored file on her husband’s computer – which would not be treated as wiretapping”. Judges rejected that argument and, even worse, O’Brien can’t use the information she gathered in her divorce proceedings.
